In light of the complaints that the latest Unelco blackout, which took place last Tuesday, August 5, has sparked on the island, the Chamber of Commerce has wanted to make public the rights that assist companies that were harmed, since they assure that many of those affected have approached the Chamber to make inquiries regarding the claim procedure.
For this reason, the Chamber reports the procedure that, according to Royal Decree 1955/2000, companies must follow. First, a written claim must be submitted to the High Voltage Exploitation Department of the supplying company (Unelco in this case). The claim must specify your personal data and contract number with Unelco, specify the facts and, if applicable, the request for compensation that you request, attaching the technical documentation that justifies it. The supplying company's deadline to respond is approximately 10 days. Claims will be submitted at the UNELCO offices in Lanzarote, located on Paseo Charco de San Ginés s/n - Edificio Atlántida. In the event that the response to said claim does not satisfy the claimant's expectations, the Chamber explains that the latter will have to go, as a second instance, to the General Directorate of Industry and Energy of the Government of the Canary Islands (Tel: 928 899 400). The document may be submitted to the Lanzarote office of the General Directorate, located at Calle José Antonio 108, local 82 (Tel: 928 807 049).
The claim before this institution will be resolved within an approximate period of 3 months, and during the processing Unelco will be given the possibility to make its allegations. The General Directorate will resolve regarding the existence of supply interruptions and quality of supply, with the effects included in article 105 of Royal Decree 1955/2000. The claim before the General Directorate will not resolve on compensation for damages derived from the interruption. For this case, parallel to the claim before the Government of the Canary Islands, it will be necessary to go to the jurisdictional route. It is advisable that the administrative claim includes that the lawsuit has been filed to request damages.
