Juan Francisco Rosa "has been, objectively considered, one of the main beneficiaries of the allegedly criminal conduct of José Francisco Reyes as mayor of Yaiza." This is what the Prosecutor's Office maintains in the document it has sent to the Court of First Instance Number 2 of Arrecife, in which, however, it requests the dismissal of the proceedings against him and ten other businessmen, within the framework of the "Reyes case".

The prosecutor argues that there is not enough evidence "to formulate an accusation", although there is a "accumulation of indications" that led to his indictment and investigation in this case. In his writing, the Prosecutor's Office recalls that Rosa is linked to "four important matters". On the one hand, in the construction of residential homes in the Playa Blanca Partial Plan, declared illegal by the Justice. On the other hand, in the construction of the Marina Rubicón Marina, together with Rafael Lasso and Francisco Armas. A license that they obtained six days after requesting it, when the works had been going on for more than two and a half years and were almost finished, after having started without having "a single permit".

Now, within the framework of this investigation, the Apmun has said that the port does not comply with any type of current planning: neither municipal, nor insular, nor state, since it also violates the Coasts Law. In addition, the port gave free mooring for years to the family yacht of José Francisco Reyes, which initially led to the indictment of the three promoters, for an alleged crime of bribery in the form of a "gift". In his writing, the prosecutor recalls that Reyes bought that boat paying 120,000 euros in cash, with money of "unknown" origin.

"Extravagant change of criteria"

To all this we must add the licenses that Reyes granted to Juan Francisco Rosa to build two hotels that have been declared illegal by the Justice: the Princesa Yaiza and the Apartotel Son Bou. The prosecutor emphasizes that "one of the main reasons that invited suspicion, and therefore his indictment", is in the extravagant change of criteria" of José Francisco Reyes.

Before Juan Francisco Rosa bought that plot, Reyes denied ("in accordance with the law") a license requested by the previous owners. However, when the land was acquired by Rosa, the response to the license application was positive. And all this, according to the prosecutor, without there being "any change, beyond the change of applicant", and without any of the accused, including the technicians of the City Council, "having been able to give an explanation" during the investigation of the case.

Another businessman "notably benefited"

The prosecutor's report also makes special reference to another of the businessmen, Ignacio Díaz de Aguilar, of whom he affirms that "both he and other members of his family have been notably benefited by the allegedly prevaricating conduct of the accused". In this case, the licenses are focused on the Las Coloradas Partial Plan and the Playa Blanca Partial Plan, although also, "to a lesser extent, in the Montaña Roja".

In this case, he recalls that "through the entity Las Coloradas S.A. and others linked to it or to his professional office, multiple urban licenses were obtained, requested by the accused or persons on behalf of said companies, on many occasions with projects drafted by an architect brother of his, and on other occasions selling real estate promotions through another brother, through another company".

In the case of the Playa Blanca Partial Plan, its development was residential and they built and sold homes to third parties. Today, those buyers find themselves with illegal houses, for which in many cases they are still paying the mortgage, without knowing what their future will be.

However, as with other defendants, such as the Basques Félix Receta, Ricardo Sánchez and José Ramón Olaberría, who also received licenses to build in the same Playa Blanca Partial Plan, despite the fact that its urbanization was illegal, the Prosecutor's Office emphasizes that the indications that exist "are not sufficient" to take them to the dock.

"No direct evidence of the delivery of the money can be practiced in the trial today, whether it was for obtaining the licenses or later for said obtaining or for another reason, whether it was for Reyes, for the Nationalist Party of Lanzarote or for both", the prosecutor points out in his writing, in reference to the alleged bribes that were being investigated by the Basque businessmen.
