The Prosecutor's Office has requested 15 years in prison for Sebastián B. H., the alleged perpetrator of the crime that ended the life of Gerardo R.G. in La Graciosa. The Public Prosecutor's Office has also requested that the alleged perpetrator of the events compensate the victim's widow and her children with more than 200,000 euros.
The Prosecutor's Office considers that in the early hours of July 28 to 29, 2010, the accused met the victim in a pizzeria. According to the indictment, "Gerardo and Sebastián were distant relatives and lifelong neighbors of La Graciosa." "Their relationship was not good, because on the occasion of a work in Gerardo's house, the house of the accused's mother had been filled with earth, and this was something that Sebastián did not forgive Gerardo, who took the opportunity to bother him whenever he had the opportunity since that day," according to this document, to which La Voz has had access.
During the meeting in the pizzeria, "an exchange of words between them" began. In this way, "a fight began in the course of which they hit each other and ended up falling to the ground." This fight ended due to the intervention of those who were at that time in the pizzeria, according to the Prosecutor's Office.
The indictment also explains that the victim left the pizzeria, while the accused remained a few minutes in it. "The accused took the opportunity to take out some scissors that he was carrying in his backpack and put them in the right pocket of his pants, confident that if they met again when he left, he would use them to kill him," he says.
The defendant left the bar and headed towards his house. In the vicinity he met the victim, who had come there "to try to fix things." "At that moment they begin to argue and get involved in a new fight, in which both grab and struggle with each other using only their hands," says the Prosecutor's Office, which points out that the accused took the opportunity to "take out the scissors that minutes before in the bar he had kept in his pocket, and with the intention of causing Gerardo's death or with knowledge that he could cause it, he stabbed them, twice in the chest."
After that, the stabbed man managed to get to his house, but collapsed at the door, in the presence of his children. Previously, he had managed to tell his wife that "Chani had pricked him." Subsequently, he died as a result of the hypovolemic shock caused by the "laceration of blood vessels and perforation of the lung parenchyma," as indicated in the forensic medical report.
