The Court confirms the ownership of the land acquired by the City Council for sports use in Playa Honda

The company Caldera de Tisalaya S.L. appealed the ruling issued by Court number 3 of Arrecife, alleging that the total ownership of the space belonged to it.

The Provincial Court of Las Palmas de Gran Canaria has rejected the appeal filed by the company "Caldera de Tisalaya S.L." against the ruling issued by Court number 3 of Arrecife that dismissed the lawsuit filed by said company against the City Council of San Bartolomé and against the Toledo Miranda family, in which the aforementioned company alleged that all of the land acquired by the City Council was their property.

In 2012, the City Council of San Bartolomé bought the land that borders the east side of the Airport (behind Calle Mástil) from its two owners, through a deferred payment of 15 years for which it would finally give one million euros to each of the parties. In this place, the City Council plans the construction of a sports area.

Five years later, Jesús López Ramírez - through his company Caldera de Tisalaya S.L. - filed a lawsuit against the City Council and the Toledo Miranda family before the Court of First Instance number 3 of Arrecife, claiming that he was the sole owner of the entire land and not just a part of it. However, the Court determined that the plaintiff was not right and that the City Council, with its transaction, acted according to the law, siding with the family that was represented by the lawyer Erardo Ferrer.

Confirmation of the sentence

After that, the plaintiff went to the Fifth Section of the Provincial Court of Las Palmas de Gran Canaria, an organization that, after studying the case, has confirmed the Court's ruling and has rejected the claim of new land ownership by Jesús López Ramírez - and his company Caldera de Tisalaya S.L. -, respecting the acquisitions legally made by the City Council of San Bartolomé to the Toledo family.
