A defendant is being tried for sexually abusing two minors in Arrecife

The Prosecutor's Office requests an 18-year prison sentence for events that began "between 2010 and 2011" and extended "until 2018"

The First Section of the Provincial Court is trying this Monday a man accused of a crime of continued sexual abuse against two minors in Arrecife, for whom the Prosecutor's Office is requesting an 18-year prison sentence. 

The trial began around 10:50 a.m., but the court has not allowed the media to take images of the accused to protect the victims and their family environment. In addition to the defendant, six witnesses and four experts are scheduled to testify.  

According to the indictment, the defendant had a romantic relationship with the great-aunt of the girls, with whom he lived since 2010, and took advantage of "the special relationship of trust he had with the parents of the minors" and "the young age of both." Thus, he maintains that "motivated by the desire to satisfy his sexual appetite when the minors stayed to sleep" in the couple's home, "between the years 2010 and 2011" the accused began "to touch" one of them, when she was "six or seven years old."

The Public Prosecutor's Office details that initially the abuses consisted of passing "his hand over the belly and under the pants" of the minor, but that these continued in subsequent years, even penetrating her and forcing her "to masturbate him" and "to perform fellatio on one or two occasions." According to the Prosecutor's Office, M.G.M took advantage of the fact that "he was alone with the minor" and told her that "this was a secret and she should not tell anyone", causing her "great fear."

All this, according to the Public Prosecutor's Office, occurred "until 2015" when the minor, who was approximately 11 years old, told the defendant "that she was going to tell her mother." Then, it is indicated that the abuses against her ceased, but that M.G.M. took advantage of "the young age" of the sister to "touch her."

According to the Prosecutor's Office, when the younger sister "was six years old", the defendant "lowered her pants, rubbed his genitals against her", "touched her genital area with his hand and took the minor's hand towards his penis so that she would touch it." These acts "occurred until December 2018, when the minor was eight years old."

 

Supervised release after serving the sentence

The Ministry considers that the events constitute two crimes of sexual abuse of minors under 16 years of age, one of them with carnal access, and requests for the accused, who is in pre-trial detention for these events, a sentence of 12 years in prison for the abuse against the older sister and six years in prison for the abuse of the younger sister. Likewise, the Prosecutor's Office requests that M.G.M. compensate the older sister with 40,000 euros "for the psychological injuries suffered" and the younger sister with 10,000 euros "for the moral damages caused."

Similarly, the Public Prosecutor's Office requests that the accused be prohibited from approaching within 500 meters of the victims or communicating with them, in the first case for 15 years and in the second for 10. If convicted, it also requests that supervised release measures be imposed once the sentence is served.

Among these measures, it requests the prohibition of approaching within a radius of less than 300 meters" to the older sister for another eight years and to the younger sister for seven, as well as the prohibition of going to any playground during that period of time and the obligation to participate in sexual education courses.
