The Superior Court of Justice of the Canary Islands has issued a ruling dismissing the appeal filed by the entity SALMEPA S.L., owner of the Arrecife Market building, against a previous resolution of the court itself, which agreed to declare inadmissible SALMEPA's lawsuit against the declaration of the building as an Asset of Cultural Interest (BIC).

The judicial resolution rejects the property's arguments against the July 2007 order, which sided with the legal services of the Cabildo. The lawyers detected a series of exceptions or defects of a procedural nature in the filing of said appeal, which made it inadmissible for legal purposes. With this new decision, the Canary Islands Court confirms the dismissal of the Mercadillo case.

The declaration of BIC for the Mercadillo, approved on June 13, 2006, was promoted by the Heritage area of ​​the Cabildo of Lanzarote itself, given the unique values ​​that the property contains. However, SALMEPA S.L., belonging to the well-known island businessman Juan Francisco Rosa, has repeatedly shown in the Courts its disagreement with this measure, alleging that the building does not meet such characteristics and that, in addition, it restricts the urban development of the traditional Mercadillo.
