The Prosecutor's Office has argued that the Contentious-Administrative Court Number 5 of Las Palmas is not competent to resolve the dispute over the Cabildo's eviction of the Cueva de los Verdes, in Haría, but that it should be analyzed in the Superior Court of Justice of the Canary Islands. In a document, dated October 15, the prosecutor states that the documentation received deals with the resolution of the collaboration agreement between the Cabildo and the Haría City Council for the creation of the Tourist Centers.

And, based on this hypothesis, he affirms that the law "grants objective competence" to the contentious-administrative chambers of the Superior Courts of Justice, "with respect to agreements between public administrations, whose powers are exercised in the territorial scope of the corresponding Autonomous Community".

Therefore, the prosecutor considers that in the "matter object of the present process", the Contentious-Administrative Court Number 5 of Las Palmas "does not have objective competence to hear it, as its knowledge corresponds to the contentious-administrative chamber of the Superior Court of Justice of the Canary Islands".

The Haría City Council believes that the prosecutor's document "does not reject" the Cabildo's eviction of the Cueva de los Verdes, as a regional newspaper published this Tuesday. Even, the Consistory has issued a press release in which it assures that these information published in other media are "interested" and, in them, "the merit of the Prosecutor's Office report is given to the Cabildo".

For this reason, it wanted to clarify that the prosecutor "takes a position in favor of the competence of the Superior Court of Justice of the Canary Islands" and "recognizes" the fact of the ruling of an agreement signed between both institutions, but at "no time does a resolution occur".

Thus, the Haría City Council has assured that "it regrets the media intoxication encouraged and sponsored by those who know this news, without determining the scope or the repercussion of these intoxications, further complicating the tense relations existing between the Haría City Council and the Cabildo". "Apparently, the latter intends to put it out by throwing gasoline", the northern Consistory pointed out.
