"Let's see if some kind of allegation can be made, because we understand that it is practically impossible to carry out this sentence in the sense that to demolish the parking lots it would also be necessary to demolish the Islas Canarias park", Antonio Hernández explained. According to the Councilor for Urban Planning, the City Council's lawyers will work to "make the competent authority aware of the situation and reconsider the damage that is going to be done to the city and to the City Council itself."
This demolition could cause serious damage to the City Council in the event that the owner of the underground parking lot claimed their exploitation rights. "If we were going to demolish a parking lot whose license has been granted by the City Council itself, the owners would go against it, and this would greatly harm the municipal coffers," said the Councilor for Urban Planning.
For the moment, the parking lot remains open. But time is running against the Arrecife City Council, since, as Antonio Hernández himself explained, the sentence would have to be executed within two months. "Taking into account that the document arrived on January 9, it is practically impossible," he pointed out.
In 2002, the César Manrique Foundation filed an appeal against the licenses granted by the capital's City Council for the construction and opening of this parking lot, located in the heart of Arrecife. In 2006, the Superior Court of Justice of the Canary Islands issued a ruling in favor of the Foundation, arguing that it violated the Arrecife Planning Plan itself.
