The Contentious-Administrative Court No. 5 of Las Palmas has issued a recent Order dated 20-6-2008 by which it agrees to the suspension of all licenses that the former mayor of Yaiza, José Francisco Reyes, granted to Pedro de Armas Sanginés for the construction of 10 luxury villas on plot R-17 of the controversial Playa Blanca Partial Plan, understanding that these licenses could be obviously incurred in causes of nullity as they are urban planning permits that authorized works in the scope of a Partial Plan that the Cabildo of Lanzarote considers non-existent since 2003, in which, therefore, absolutely nothing could be built, neither tourist nor residential.
The Court has also ordered the registration of the appeal in the Land Registry so that possible buyers of these homes are not surprised in their good faith and are aware at all times of the situation in which the works are located and the existence of the lawsuit that the Cabildo of Lanzarote has filed against them.
The granting of the licenses that on 11-14-2005, 11-22-2005 and 1-20-2006 the former mayor of Yaiza and still vice president of the PNL, José Francisco Reyes, granted to the company of the secretary general of his party, Pedro de Armas (Marivista SL) and that Justice has just paralyzed because it suspects that they are manifestly illegal, was the subject of controversy at the time between the Cabildo and the aforementioned City Council, because when the municipal corporation of Yaiza was forced by the Courts to communicate to the Cabildo all the permits it had granted in Playa Blanca and on April 6, 2006 the City Council sent the first Corporation these authorizations (about 400 licenses), among these licenses there was none of those that Reyes had granted to the family business of the secretary general of the PNL, which meant that these licenses were not initially appealed by the Cabildo, until through a [journalistic information that La Voz de Lanzarote advanced->http://www.lavozdelanzarote.com/spip.php?article11967] its existence was known.
Shortly after obtaining the municipal permits, the family business of Pedro De Armas, Marivista S.L., sold the land, already with the licenses granted by the former mayor of Yaiza, to the company "Villas Blancas Lanzarote S.L.", which is the current promoter of the works.
The paralysis of the licenses comes at a time when the works have not been completed, so the constructions can no longer be completed, at least until a final judgment is issued in the judicial process that the Cabildo maintains against this license, which is identical to the one it maintains against all licenses granted in the Playa Blanca Partial Plan, where, in addition, it is the fourth time that the Contentious Courts have suspended licenses.
