The Agency for the Protection of the Urban and Natural Environment (Apmun) has ordered the demolition or legalization of a construction on rustic land with landscape value protection, in a place called La Cueva, in San Bartolomé. Last December, Apmun initiated the procedure against this house and gave those affected 15 days to present allegations. This Tuesday, the Official Gazette of the Canary Islands (BOC) publishes the resolution, which exhausts the administrative channel.
Apmun maintains that an infraction has been committed against territorial planning and orders the demolition of a house of 82 square meters, expanded by 20 square meters, as well as a garage of about 24 square meters, a cistern, a corral and the corresponding wall.
This house is located in La Cueva, on rustic land with landscape value protection, included in the protected natural area of La Geria. Therefore, Apmun orders "to restore the altered physical reality to its original state".
However, and prior to the demolition, the Agency gives a deadline to initiate the legalization of the house. In addition, it warns that if legalization is not initiated within the granted period or if it is denied, "the demolition order must be executed, in the time and manner indicated by the administration for this purpose".
With this act, the administrative channel is exhausted. From now on, interested parties can file an appeal with the executive director of Apmun, and with the Contentious-Administrative Court.
