The Contentious-Administrative Court number 1 of Las Palmas has declared null the dismissal of the former municipal secretary of the Arrecife City Council, Asenet Padrón, ordered by the previous government group, formed by PP and PSOE, in January 2012. The sentence, released by Alternativa Ciudadana, considers that the dismissal was not motivated.
"The dismissal had nothing to do with the secretary's professionalism," says AC. In addition, the formation has assured that the sentence declares this dismissal null because it considers that the position held by this official "was neither a position of political confidence" nor was it "to carry out personal assignments" of the then mayor, Cándido Reguera, or the deputy mayor, José Montelongo, "but only for those functions that are proper to her position as secretary."
According to Alternativa Ciudadana, the sentence indicates that it is "necessary to guarantee" the "independence" of the secretary "to preserve her professionalism when exercising her work." Therefore, the formation emphasizes that the dismissal was an "arbitrary" exercise, since in no case was it motivated by professional reasons.
For their part, sources from the Consistory emphasize that the Court has also dismissed other claims of the former secretary in its ruling.
A dismissal motivated by a "personal matter"
Faced with this sentence, Alternativa Ciudadana has once again attributed the decision to dismiss the secretary to "issues of a personal nature", which at the time were a "real political scandal". Thus, it has insisted that the official reported the entry into her office by the then mayor, Cándido Reguera, the deputy mayor, José Montelongo, and the councilor Nayra Callero, as well as the "disappearance" of documents.
"Later this matter would be related to the so-called 'Montecarlo' case, where both Cándido Reguera and José Montelongo are accused. A case that, to this day, is being resolved in the Courts of Arrecife," recalled Alternativa Ciudadana.
The formation has insisted that it is now up to the current government group, formed by CC and PSOE, to resolve this situation, since a decree of dismissal of the secretary is judicially revoked. This position has been occupied accidentally by various people, without being able to say today "if this fact could be harmful to municipal interests".
Faced with this judicial resolution, AC has stated that "professionalism should prevail in public administration" to end "the misuse that certain political positions, in this case from the PP and PSOE, intend to carry out on the professional work of public officials, giving priority to cronyism and political favoritism, rather than to capacity and merit".
