The Prosecutor's Office requests nine years in prison for the accused of skippering a small boat and assaulting two passengers

Section Six of the Provincial Court of Las Palmas will try on January 18 a migrant person accused of steering a small boat from Morocco to Lanzarote. The precarious vessel arrived on the island on December 13, 2022 at 05.30 hours at night with 35 people on board. 

The defendant A.H. has been in provisional detention since January 5, 2023 for this case.

According to the Public Prosecutor's Office, the precarious vessel departed on December 9, 2022 from Morocco without any security measures, nor sufficient water or food.

After five days at sea and during the early morning of the last day, the Prosecutor's Office accuses A.H. of tying a piece of clothing around the neck of one of the passengers and pulling it, while shouting at him, and of hitting another with a stick on the head.  

The passenger who suffered the stick in the head had a superficial wound on the scalp, which did not require medical or surgical treatment. 

The Public Prosecutor's Office points out that the facts are constitutive of a crime against the rights of foreign citizens, another of threats and a third minor crime of injuries. 

For the crime against the rights of foreign citizens, considering him the skipper of the boat, he demands eight years of prison, special disqualification for the right of passive suffrage during the time of the sentence. After that, for the crime of threats, he requests the penalty of one year of prison and to conclude, three months of fine with a fee of ten euros per day with subsidiary responsibility in case of non-payment.

In addition, the payment of the procedural costs and the compensation to A.O. with 302 for the injuries caused.
