The Prosecutor's Office is asking for a three-year prison sentence for the mother of the child who died a year and a half ago in Puerto Naos, when the vehicle in which they were traveling fell into the water. In addition, it considers that the Port Authority of Las Palmas is subsidiarily civilly liable for the death of the minor.
The events occurred on October 31, 2008 at eleven o'clock at night. The child's mother, Simone Luiza Nogueira, was driving her car under the influence of alcohol and fell into the sea with her vehicle. She was able to get out of it, but the child, who was traveling in his regulation seat, was trapped and died.
The Prosecutor's Office requests three years in prison for the mother for a crime of reckless homicide and another against road safety. In addition, it asks for five years of deprivation to drive motor vehicles and mopeds and compensation of 100,000 euros for the child's father, which must be paid subsidiarily by the insurer and the Port Authority.
According to the Prosecutor's Office's indictment, "as a result of the combined effect of the alcohol in her body and the poor lighting of the place, the accused became disoriented to the point that she did not realize that instead of taking the road in the direction of her home, she continued and in just a few meters she entered, without any impediment, the facilities of the port area of the Port of Arrecife, known as "Puerto Naos".
The accused was driving from Arrecife to Costa Teguise but took the wrong road. The Prosecutor's Office also highlights that the car was "circulating directly along the entire length of several hundred meters of the berthing line of the old fishing dock, which caused that at the end of it, it plunged into the sea at around 11:10 p.m.".
More accidents
In addition, the Public Prosecutor's Office underlines the responsibility of the Port Authority, reflecting in its accusation the fact that in December 2005 "two other young people died when the vehicle they were traveling in fell into the water inside the Puerto Naos facilities". For this case, the driver has just been sentenced to two and a half years in prison.
There are several cars that have plunged into the water in Puerto Naos in recent years and many accidents that have occurred on that dock. After the accident for which the Prosecutor's Office is now accusing, the Port Authority of Las Palmas decided to fence the area and prevent free access of vehicles to the dock.
