The Sixth Section of the Provincial Court of Las Palmas has postponed the trial in which a father was to be tried for allegedly sexually abusing his daughter in Costa Teguise. The Chamber of which Ricardo Moya is the head has taken this decision after the defense of J.R.G.N. pointed out that the victim's mother could not continue as a private prosecution because the young woman, who was 15 years old when the events occurred, had already reached the age of majority.
Despite this, the Prosecutor's Office and the victim's mother's lawyer have argued that they continued to defend on behalf of the young woman because she was a minor when the situations of alleged sexual abuse took place. At that time, the presiding judge attributed the situation to a "procedural irregularity", since the Administration did not ask the minor if she wanted to continue with the judicial process, if she wanted to keep her mother's defense lawyer or the same solicitor.
For the same reason, the victim went to the courtroom with a screen separating her from her alleged abuser. At that moment, the judge asked her if she wanted to continue with the case, keep the lawyer and the solicitor. Although her answer was affirmative, the Court considered that there was no time to continue the process that day and postponed the hearing to a new session when the solicitor was notified of the change and accepted it.
While the defense of J.R.G.N. asked for the trial to be annulled for this reason and because he had not been able to access the messages and calls from the mobile phone confiscated from the alleged aggressor, the Court decided to continue with the process another day. "It does not give rise to an improper suspension," the Prosecutor's Office and the lawyer of the private prosecution had already stated.
The Prosecutor's Office is asking for a total of eight years and three months in prison for the accused JRGN, a restraining order of more than 500 meters for ten years and sexual education courses for a continuous crime of sexual abuse of a minor under 16 years of age with the aggravating circumstance of being her father.
The Public Prosecutor's Office stated that the events date back to before the summer of 2018, when JRGN, being the minor's adoptive father, blackmailed her by touching her to allow her to go out with her friends.
