The Sixth Section of the Provincial Court will try this Friday in Arrecife JRGN, accused of a continuous crime of sexual abuse against his adopted daughter, a minor of 16 years. Likewise, the Chamber adds as an aggravating factor the position of authority and trust that the father had over the minor.
The Prosecutor's Office is asking for a total of eight years and three months in prison for the accused, a restraining order of more than 500 meters for ten years and sexual education courses, among other things.
The events would have occurred in Costa Teguise before the summer of 2018. According to the Prosecutor's Office's indictment, at that time, JRGN allegedly made sexual requests to his 15-year-old daughter, taking advantage of his status as an adoptive parent, in exchange for letting her go out with her friends. In this case, he touched the minor's breasts on several occasions underneath her shirt.
Also, in another episode, already in the summer of 2018, the minor told her father her concern when she thought she might be pregnant by her boyfriend. The accused would have performed some touching, "encouraged by the desire to satisfy his sexual appetite and taking advantage of the relationship of familiarity, licked her breasts and touched her genitals over her clothes," the Public Prosecutor's Office states.
Also, between September and December 2019, the accused tried to kiss a 17-year-old friend of his daughter on two occasions. The first in Famara and another at a party in Varadero.
Prison sentences
In its indictment, the Public Prosecutor's Office asks the accused for a prison sentence of five years and six months, as well as special disqualification for the right to passive suffrage during the term of the sentence for a continuous crime of sexual abuse of a minor under 16 years of age. At the same time, a restraining order at a distance of less than 500 meters from any place where she is, as well as the prohibition to communicate with her by any means or procedure for ten years.
Likewise, once the sentence has been served, the Public Prosecutor's Office requires the obligation to participate in sexual education courses for six years.
To this must be added the continuous crime of sexual abuse, taking advantage of a situation of trust, familiarity or authority, for which the Public Prosecutor's Office asks for two years and nine months in prison, special disqualification for the right to passive suffrage during the term of the sentence, a restraining order of 500 meters for ten years and sexual education courses for six years as a supervised release measure.
Regarding the payment of civil liability, the Prosecutor's Office asks the accused to compensate the minor with 6,000 euros for moral damages caused and the legal representative of the minor's friend for 3,000 euros.
