The Contentious-Administrative Court Number 5 of Las Palmas de Gran Canaria has sided with the Cabildo and has rejected the Haría City Council's attempt to execute the Cueva ruling, warning it that the order that did not approve the agreement between both corporations is not final and imposing the payment of the costs generated.
In the dismissal order, the Court considers that the request of the Haría City Council should be dismissed due to "the correct arguments presented by the Cabildo of Lanzarote and the Local Business Public Entity Centers of Art, Culture and Tourism of Lanzarote." In its opposition, the legal representation of the Cabildo and the Centers maintained that Haría's claim went against what was stated by the City Council itself, which, in its writing of formulation of the incident, recognized that the nullity of both the agreement and the addendum in force should be declared beforehand, a matter that is still pending resolution.
In addition, the Court points to another contradiction in the attitude of the Consistory. "It is understandable the urgencies of said Corporation to obtain the amounts to which it is entitled, a different matter is whether the opening of multiple pieces and the interposition of a new contentious-administrative appeal that has been distributed to this Court will, precisely, speed up the resolution of the conflict that exists between the parties," the order underlines, warning that these new judicial fronts will continue to delay the payment of the money that was recognized in a ruling since 2015.
The Court refers to another request made by the current government group on February 15, in which it recognized that before determining the amount corresponding to Haría as compensation - that is, what has now been rejected - the nullity of the extrajudicial agreement signed in its day by Pedro San Ginés and Marci Acuña, as well as the addendum to the agreement approved in October 2020, under the Mayoralty of the PSOE and thanks to the divided vote of CC, should be declared.
Now, with Coalición Canaria in the Mayor's Office and in government with the Platform of José Torres Stinga, they have tried to annul both agreements, but at the same time they have asked that the amount of compensation be determined in court. "It goes against their own reasoning," the Court warns.

In a statement, Corujo has reiterated the "firm will" of her government group to "put an end to this situation guaranteeing every last euro of what corresponds to Haría" and has reproached the current pact that governs in the northern City Council "its effort to generate problems where there are none, entering into artificial confrontations that respond to the need of some to justify the unnatural pact to which their pride has led them."
The president has referred to the procedure, also filed by the current government group of the northern city council, in which it requests the annulment of the agreements reached, ignoring the lack of firmness of the order that initially denied their approval.
"The court itself warns that the excessive litigiousness of the current government group of Haría does not contribute to speeding up the definitive solution of the artificial conflict in which they have put the city council," Corujo concluded.
