The Sixth Section of the Provincial Court of Las Palmas has acquitted the lawyer and businessman Luis Lleó of the corporate crime against his family for which he was sentenced by the Criminal Court number 1 of Arrecife to 15 months in prison, according to La Provincia.
The businessman Luis Lleó, who is one of the main defendants in the Unión case, was denounced by his nephew, Aday Lleó, partner in the company 'Consultores y Asesores Legales Lleó S.L. The court of first instance considered that Luis Lleó had undermined the patrimonial interests of his nephew for what happened in a General Meeting of the company held in April 2015.
In that meeting, Luis Lleó "removed Aday Lleó and his brother Jaime Lleó from their positions as joint administrators", appointing himself as the sole "administrator" of the company, after both left it, also giving himself authorization to take actions against his nephew. To do this, Luis Lleó "modified the management and administration regime" of the company, "which became sole administration" and "changed the registered office, which was in Arrecife, moving it to Las Palmas de Gran Canaria".
Luis Lleó's nephew alleged that he had left the Board because its constitution was not valid because there was no secretary present. However, the Provincial Court does not consider this to be the case and, therefore, has revoked the judgment of first instance acquitting Luis Lleó, who in addition to 15 months in prison, had been imposed a penalty of special disqualification for the exercise of the position of director of a commercial company for the same time, as well as the payment of court costs.
Luis Lleó however has another trial pending for the management of this company, in which the Prosecutor's Office is asking for four years in prison and his family, who is exercising the private prosecution, 13 years in prison, in addition to a fine of 72,000 euros and compensation of 146,791 euros for crimes of misappropriation and attempted fraud, among others.
