Six years in prison requested for the accused of defrauding the administrator of Silvano Inversiones SL

The sole administrator of TORRESCL sued the affected party for more than 470,000 euros, without informing them that they had a debt forgiveness agreement.

The Second Section of the Provincial Court of Las Palmas will judge on November 22 in Gran Canaria the sole administrator of the commercial entity TORRESCL SL, J.J.G.A. who was accused of defrauding the administrator of another company.

The accused J.J.G.A., as the sole administrator of the company TORRESCL SL, filed a lawsuit in July 2013 against the entity Silvano Inversiones SL. With it, he requested the holding of an ordinary trial where he claimed 478,424.22 euros.

According to the prosecution's indictment, the accused filed this lawsuit, "being fully aware" that there was a donation agreement for debt forgiveness for the amount required in favor of the entity Silvano Inversiones SL.

The previous sole administrator of TORRESCL SL had signed in March 2012 a contract to release Silvano Inversiones SL from the debt. However, the accused J.J.G.A. allegedly concealed this contract from the Court.

The Public Prosecutor's Office argues that this "action" resulted in a "significant economic harm" against the administrator of Silvano Inversiones SL, who had to auction off more than a dozen properties to meet that payment. For this reason, he accuses J.J.G.A. of a crime of fraud for which he asks for six years in prison, special disqualification for the right to passive suffrage during the term of the sentence and a penalty of 18 months of fine, with a daily fee of 25 euros.

In addition, he requests that both the accused and the commercial entity he represents jointly and severally indemnify the affected party.
