The veterinarian of the municipal kennel of Arrecife, Javier López, presented on June 25 a document in the Court of Instruction number 4 of Arrecife renouncing the exercise of private prosecution in the case against the chief sergeant of Seprona in Lanzarote, Gloria Moreno, and against the councilor of Podemos in Arrecife, Leticia Padilla, also requesting the file of the same.
In the document, the municipal veterinarian explains that he had denounced Leticia Padilla and Gloria Moreno for a crime of slander and another of infidelity in the custody of documents, "based on the use by the former, during the month of April 2018, of various documents (registration books), which should be in the exclusive possession of the Civil Guard, as it referred to an administrative procedure in progress."
Specifically, Javier López stated that "making use of these documents", Padilla had stated "repeatedly in local media the alleged commission of a criminal act" on his part, "and all this in relation to the exercise of his functions as a municipal veterinarian."
Thus, "in protection of his right to honor", the municipal veterinarian denounced this conduct, "which was based on the leaks of documents from an administrative file of the Civil Guard. And Javier López understood that Gloria Moreno "could be directly responsible for such leaks, for being the head of Seprona on the island" at that time "and for the previous problems that existed between the non-commissioned officer and the complainant", since he "had been involved in several administrative and criminal proceedings at the request of Gloria."
Moreno was "on leave" and "proved" that she did not leak documentation
Now, however, after the statements in court on June 20 by Gloria Moreno and Leticia Padilla as investigated, the municipal veterinarian has decided to renounce the private prosecution and, in turn, request the dismissal of the case. And, he points out that from the statement of the chief sergeant of Seprona "it is clear that the documents of the administrative file were sent to the Mayor's Office of the Arrecife City Council by means of an official letter dated February 24, 2016, date on which the sergeant was on maternity leave".
In his writing, Javier López states that he does not know "why that documentation was sent to the City Council and addressed to the Mayor's Office in particular, as the City Council was not part of any procedure", but he states that "Gloria Moreno was able to prove that the documents were sent by the Head of the Detachment at that time", so he considers that "in no way can a typical action of any kind be inferred with respect to the sergeant, as she was on leave and did not send any documentation with the intention of leaking or harming" his image.
"This fact distorts the presumption of the private prosecution at the time of filing the complaint, since the complainant's knowledge about the sending of said documentation occurs in April of this year, when almost two years had passed since its actual sending, so there is nothing to claim from Gloria Moreno for the reported facts", is stated in the document presented in the Court of Instruction number 4 of Arrecife.
In it, the municipal veterinarian also states that he deduces that "there was no concurrence of wills between the investigated parties". "And there being no crime of infidelity in the custody of public documents on the part of Gloria Moreno, this party withdraws from the exercise of the private prosecution", concludes the municipal veterinarian, also requesting the dismissal of the case.
