The government group of Tías claims to have obtained the endorsement of the Canary Islands Advisory Council on the procedure initiated by the City Council to terminate the award contract to Ingemont "for non-compliance" of the new building of the Municipal Sports Center. According to the Consistory, the opinion of the Advisory Council concludes that "the procedure followed by the Tías City Council to terminate the contract and proceed with the claim for damages incurred by Ingemont is correct, both in form and substance," a firm that recalls that "is known in Lanzarote for its unfinished and unfinished works or projects."
Ingemont, Proyectos y Montajes was the company that won the contest launched by the Tías City Council in 2015 for the construction of a two-story interior building in the Municipal Sports Center. This property, within the modernization projects of the Tías Sports City, was awarded for 204,000 euros to the aforementioned company. Among the reasons for awarding this building to Ingemont, according to the resolution of the Contracting Table, were its delivery times.
The construction company began its construction, but "consumed its legal deadlines without finishing and delivering the building." Thus, the City Council approved initiating a sanctioning file to Ingemont with a claim for damages, "for non-compliance with the administrative deadlines and criteria of the work." Previously and mandatory, the Consistory requested an opinion from the Canary Islands Advisory Council to terminate the contract.
Works underway "for its upcoming opening"
In this way, once this route has been resolved, with its corresponding reports and appeals from the company, the City Council points out that it has been able to "rescue" the work and continue the work to complete it. Mayor Pancho Hernández has advanced that "it is desired that it can be operational soon." Its gym on the ground floor will be used - within the modernization of the interior and exterior of the Sports City - for martial arts, and the upper floor, which has a terrace and views of the Football Field, will be the new cafeteria of the Municipal Sports Center, "which lacked it since its construction."
From these first days of October, it is indicated that the Department of Sports of Tías is proceeding "to the necessary work to complete the facilities and assembly, among them, the channeling of ventilation equipment, necessary for its upcoming opening, among other issues."
The City Council explains that, as established by the regulations, while a work is not officially received, or the termination of the contract is accredited by a firm resolution, corporations and public institutions cannot use, access or take possession of the property or work object of the award. Thus, it is indicated that "during all this time ago, the Consistory has been in the stage of this administrative procedure to terminate the contract and initiate the file of claim for damages."
The government group of Tías also recalls that in recent times it has already executed different works, and others that are currently underway, for the modernization of the Tías Sports City. Among them, new toilets and changing rooms, accessibility and elimination of architectural barriers, this new cafeteria and martial arts room building, or all the new exterior enclosure in white concrete and parking, with access ramps adapted for people with reduced mobility or who have a disability.
