The owner of one of the historic buildings in the center of Arrecife has filed an appeal in the Courts against the latest decision of the Arrecife City Council, which suspended the granting of demolition and construction permits until the new Municipal Catalog is approved.

The City Council adopted this agreement in the plenary session held on August 7, when it considered the ruling of the Superior Court of Justice of the Canary Islands that annulled the previous Catalog, approved in 2008, to be executed. To prevent historic buildings from being unprotected, the City Council then decided to suspend the granting of licenses pending approval of the new document, which is currently being finalized.

As a result of that agreement, according to the Official Gazette of the province this Monday, María Dolores Panasco Armas decided to go to the Courts, filing an appeal with the Contentious-Administrative Court number 6 of Las Palmas de Gran Canaria.

The City Council itself has now made this appeal public in the BOP, in compliance with the judicial mandate, "in view of the plurality of interested parties", "so that anyone who considers themselves interested in the file can appear as a defendant in the proceedings, within nine days before said Court".

 

An annulled catalog and another in process


The ruling of the TSJC that annulled the previous Municipal Architectural Catalog became final last July, when the Supreme Court rejected the appeal filed by the City Council against the previous ruling.

The procedures to approve that Catalog began under the Mayoralty of María Isabel Déniz and culminated in the last legislature, during the pact between the PSOE and the PIL. Specifically, the Justice annulled the plenary agreement of July 2008, by which this document was definitively approved, thus giving the reason to one of those affected.

The Court annulled the Catalog on the grounds that the established procedure for processing it was not followed. The ruling emphasizes that there were even "critical legal reports" with the procedure that was being carried out for the elaboration and approval of this document.

After the ruling was ratified by the Supreme Court, the Arrecife Plenary adopted an agreement in August, declaring all the properties incorporated into the 2008 Municipal Catalog as part of the new catalog project that is being processed, and suspended until its final approval the granting of demolition and construction licenses in those properties.
