The mayor of Arrecife, Yonathan de León, initiated a procedure on February 2 to prohibit the company Click Asistencia SL, linked to an agent of the Local Police and career civil servant of the municipality, from contracting with the council while continuing to hold a public office in the institution.
This decision was made after the Arrecife City Council decided to suspend the contracting procedures for the crane service for the City Council's needs, the deposit service, and for the transfer of wrecked vehicles in the municipality's events after detecting possible "incompatibilities."
Upon noticing this situation, the mayor of Arrecife transferred the powers to the Contracting area, managed by councilor Echedey Eugenio (Coalición Canaria), only to resolve the files related to Click Asistencia SL.
In this case, the administrator of the company, the only one that had submitted bids for the three crane service tenders and, therefore, was going to be chosen, was a local police officer, until his resignation on September 19.
In this line, Yonathan de León reported a "possible conflict of interest" and asked to know if the police officer participated in the drafting of the technical specifications for the contracting of crane services.
At the same time, he requested that, once the prohibition is definitively declared, the contracting table reject the proposal of Click Asistencia SL and declare the tenders deserted.
In the resolution that La Voz has been able to access, the legal reports conclude that when the offers were submitted, the agent was the administrator of the company, although he resigned before the proposal for adjudication.
Agent Incompatibility
In this line, the aforementioned report highlighted the "incompatibility" of the public employee to compete with this company in the municipality's crane tenders.
In this regard, a decree signed by Yonathan de León revealed that "it is stated according to the documentation provided" that the official "has been holding the position of sole administrator of the company" without compatibility having been granted in the plenary session of the corporation.
At the same time, it pointed out that the companies of the personnel dependent on the administration and their close relatives are prohibited from being contracted by the City Council.
In addition, the General Secretariat of the City Council resolved that an "autonomous administrative file" may be initiated in a disciplinary manner, understanding that the agent would have infringed the "incompatibility regime" of the Local Police service. Meanwhile, the scope and duration of the prohibition will be greater or lesser depending on the intent or bad faith of the entrepreneur and the entity.
In this sense, Yonathan de León has transferred the case to the Personnel area of the City Council so that a disciplinary procedure is initiated against the agent "if deemed pertinent."
