The opposition group, Alternativa Ciudadana, claims that it has learned that the company exploiting the Canary Islands Parking is claiming two million euros from the Arrecife City Council for a clause included in the contract for the execution of the park's works, after the award tender. Faced with this debt, the formation will present a motion in the next plenary session in which it requests the precautionary suspension of the payment and that the legal viability of this added compensation be studied.Public knowledge of this payment occurs at a time when the Arrecife City Council has opened a judicial procedure to stop the execution of the sentence that has left the parking without legal support, considering that the license granted by the City Council is null.Apart from the controversy of the parking declared illegal, Alternativa Ciudadana now assures that on October 30, 2007, the City Council received a letter from the operating company, participated by Hormiconsa and the Marcial group, requesting an economic compensation amounting to 2,101,660.85 euros.According to the entity, the claim comes from a clause that was added to the Work Execution Report, in which the City Council assumed the cost of the construction of the park if the initial amount was exceeded.After the public tender, Hormiconsa and the Marcial group assumed the construction for an initial amount of 4,696,548.99 euros for the parking and 1,787,650.40 euros for the park.But in the report of the work execution project, the plenary of the Corporation and the Governing Board, according to Alternativa Ciudadana, approved "a tag": "The City Council accepted that in the specific case of the Park's work, in the event that the execution budget exceeded the amount of 1,787,650.40 euros, the excess would be assumed by the City Council itself".Alternativa Ciudadana wants to know if this clause is "abusive for municipal interests" and what legal effects the "modification made to the public tender" has, if no information was given to the rest of the competing companies, "since it could imply "that the file is flawed from its beginning".
