The head of the Court of First Instance number five of Arrecife, Silvia Muñoz, has condemned the local police officer of Arrecife, Narciso Pérez, for the disqualifications he made against the former secretary of the Arrecife City Council, Javier López. The local police officer in several radio interviews and writings presented to the city council called him "unpresentable official", "windbag", "bully and shameless", even insinuating supposedly criminal conduct, such as the realization of "à la carte" reports or his appointment "for political favors" or the alleged "illegality of the appointments" for the position held by the plaintiff in the city councils of Arrecife and Teguise.
According to the grounds of the judgment issued on June 12, the plaintiff offered Narciso Pérez the possibility of retracting his injurious comments, but not only did he refuse to do so in the act that was held for that purpose in the Court, but the next day he continued insisting on his disqualifications to Mr. López in various interventions in local radio programs, continuing with new disqualifications towards the plaintiff in the following months.
Now Justice, after assessing all the evidence taken throughout the judicial procedure and analyzing the expressions made by the local police officer against the former municipal secretary, has reached the conclusion that the disqualifications that the defendant made of the other municipal official are clearly defamatory and constitute an illegitimate intrusion into the honor, good name and professional prestige of the plaintiff.
In the ruling, the Court upholds the claim filed by Javier López and condemns Narciso Pérez to compensate him with 12,000 euros, for the damages that the defamations made by the former have caused to the plaintiff, also condemning him to publish the ruling of the sentence in the media where he has poured his insults and to its dissemination in writing in the Arrecife City Council itself.
