The complaint, signed by the secretary of organization of the socialists of Lanzarote and councilor of the Cabildo, Carlos Espino, argues that "the line separating administrative wrongdoing from conduct with criminal significance has been clearly crossed".
According to what is explained in the document presented by the PSOE in the Arrecife court, and always according to their version of the facts, "both the technical and legal reports issued, as well as the resolution dictated [in reference to the license granted by the mayor to Residencial Costa Roja for the construction of more than a thousand homes] have been carried out or produced knowingly of their crude and gross contradiction with the legal system, in a totally deliberate manner, with full awareness of their illegality, and with a clearly rebellious will and resolutely determined to remove all legal obstacles interposed for a diverted purpose, with the aim of obtaining the illicit benefit pursued (?)".
The PSOE defends that it has had to take this measure in the face of what it considers to be the "flagrant non-compliance" of the president of the Cabildo, Inés Rojas, and of the political group she now represents (Coalición Canaria), to take José Francisco Reyes to the criminal route if the technical reports requested for this purpose revealed any possible criminal offense.
According to the socialists, Inés Rojas and her Government have decided not to resort to criminal proceedings, among other "hidden reasons" due to "fear of being forced to make a similar decision with the Teguise town hall", governed by Juan Pedro Hernández, a fellow party member. The fact that José Francisco Reyes "was until very recently a prominent member of Coalición Canaria" is another of those "hidden" reasons considered by the PSOE. Finally, they believe that the fact that the head of the Technical Office of Yaiza, also accused in the complaint presented this Thursday, is Antonio Lorenzo Tejera, a prominent member of CC and general director of Labor of the Canary Islands until 2003, is another of the explanations for the Cabildo's decision not to take criminal measures.
For the Lanzarote socialists, Inés Rojas "has to explain to the citizens her use of double standards and the ambiguous and contradictory messages that she herself and Coalición Canaria launch with respect to her policy on sustainable development", and the reason for her refusal to allow the Cabildo to go to court "in the face of such clear evidence of an alleged urban planning illegality".
The PSOE recalls that in the plenary session of the Cabildo de Lanzarote on February 28, all the political parties represented in the Corporation took "by absolute unanimity" the agreement to resort to criminal complaint if sufficient indications of crime were appreciated, which in the opinion of the PSOE "has been demonstrated after reading the reports that the Corporation requested".
