The elderly victim of a viral kick in Lanzarote: "The Court has forgotten my case"

Despite the fact that in May 2024 the Court of Instruction sentenced two young men to pay him 270 euros for the injuries and 106 for the damages to his car, the man has not yet received the money, and the case is pending in the Provincial Court

More than two years ago, the video of T., a man of 65 years old at the time, receiving a kick in the face in Lanzarote went around social networks, filling them with indignation. Two young men who were riding a motorcycle had gotten into a traffic argument with this old man, which ended with one of them kicking him in the face and throwing him to the ground.  

Despite the fact that Justice ruled in his favor, T. denounces that he has not yet received any type of compensation for what happened. "The Court has forgotten my case," he says in statements to this medium. At that time, he spent four weeks suffering the consequences and states that he still has pain in his leg and that he had to pay for the damage caused to his car. 

As La Voz advanced, in May 2024 a court of instruction in Arrecife sentenced S.D.B.L. and P.M.R.R. to compensate T. with approximately 270 euros each for a crime of injury and to respond with 106.19 euros each for the damages caused to the victim's car. At the same time, he acquitted T. of the crime of injury and threats of which both had accused him. 

According to sources from the case confirmed to La Voz, the sentence that condemned both is not yet final, since it has been appealed by both parties. For the moment, more than two years after what happened, they must wait for the Provincial Court of Las Palmas to pronounce.

According to the judicial ruling that La Voz was able to access, the court considers it proven that at noon on June 7, 2023, T. was driving his vehicle between Puerto Calero in the direction of Tahíche, when he was at the height of the Puerto del Carmen detour, a motorcycle overtook him by crossing a continuous line and stopped in front of him, abruptly reducing speed.

At that moment, T. had to brake suddenly and honked at the defendants, who responded with a middle finger. After that, the old man continued driving, until a few minutes later, at the height of the Lanzarote Airport, he overtook the motorcyclists and asked them if they were crazy. After that, S. and P. "became aggressive" and placed themselves at the height of T., getting very close to the passenger window. 

T. accelerated the march for fear of the motorcyclists, while they followed him behind making zig zags with their motorcycle. When they arrived in Arrecife, the motorcyclists stopped the motorcycle under the bridge that connects the capital with the town of Tahíche, picked up a stone and, again on the move, P.M. threw the stone at the old man's car, damaging the rear left part of the car.

The motorcycle stopped again and T. got out of the car. In the middle of this scuffle, S.D. hit T. in the face, when he returned to the car to call the police, S.D. tried to close the door when the old man still had his leg inside up to three times and caused injuries to his leg. After that, while the victim was trying to take a photo of the motorcycle, S. gave him up to three kicks. 

Recently, one of those involved in this case, specifically P.M.R.R. was in provisional prison for six months for the aggression against the young Sicilian Salvatore Sinagra in a nightlife bar in Puerto del Carmen in January. The Italian ended up 16 days in an induced coma, struggling between life and death, and the consequences generated by the aggression are still unknown.
