The Government of the Canary Islands has decreed the expiration of numerous files to declare Assets of Cultural Interest on the Islands. The order of the Ministry of Education, Culture, Universities, Culture and Sports, published this Thursday in the Official Gazette of the Canary Islands (BOC) affects 42 real estate properties in Lanzarote, including Jameos del Agua, the Farmer's Monument, the Cueva de los Verdes, the Mirador del Río, the Cactus Garden, the Castle of San Gabriel, the Salinas del Janubio, César Manrique's house in Haría or the Casa Ajey.
As explained in the decree, the regional Executive has declared the expiration of said files as "more than 12 months have elapsed from the date of their initiation" without having been resolved.
Now, as indicated, "the procedures declared expired may not be re-initiated until a period of two years has elapsed since the effects of the expiration occurred, unless there is a request from any of the persons or entities provided for in article 31.2 of the Law on Cultural Heritage of the Canary Islands".
However, against this order that puts an end to the administrative process, an appeal for reversal may be filed with the Culture, Universities, Culture and Sports, within a period of one month from the day following its publication.
Likewise, a contentious-administrative appeal may also be filed with the Contentious-Administrative Chamber of the Superior Court of Justice of the Canary Islands within a period of two months from the day following its publication. In the case of filing an optional appeal for reversal, it is detailed that it will not be possible to go to the contentious-administrative route "until it is expressly resolved or dismissed by administrative silence within a period of one month from when the aforementioned appeal was filed". "All this without prejudice to any other appeal that is deemed necessary to file.", it is added.
