The Councilor for Classified Activities of the Cabildo, Marcos Bergaz, has come to his defense after the publication of the press release from the Popular Party about the rally, and maintains that Jacobo Medina "completely confuses" the authorization of Public Shows with the authorization provided for in the Land Law and the Protected Natural Spaces of the Canary Islands.
As the councilor explained, certain activities, such as massive concerts and sporting events that take place in more than one municipality, are subject to prior authorization under the Law on Public Shows and Recreational Activities, with the Island Government Council having delegated its processing and concession to the councilor of Classified Activities.
"This is an authorization provided for by a state law that affects numerous activities and that fundamentally aims to guarantee the safety of the attending public and that the activity to be carried out complies with the law in the broadest sense of the term, for which reports are requested from various areas of the Cabildo, such as Roads, Historical Heritage, Territorial Policy and the Environment," Bergaz explained.
Additionally, the Land Law and Protected Natural Spaces of the Canary Islands introduced in its article 80 the so-called "Island authorization of sporting events and official network of routes in the natural environment" that the Cabildo, since the aforementioned regulation came into force in 2017, had been processing jointly with the authorization provided for in the Law on Public Shows.
Given the doubts raised by the Territorial Policy report, and in order to eliminate any legal uncertainty, the Island Government Council has made an express delegation to the councilor of Classified Activities to process and grant the authorizations provided for in Article 80.
Thus, from now on, the same resolution of the councilor will contain the two authorizations, simplifying the administrative procedure and gaining legal certainty.
"Jacobo Medina is either lying or confused when he points out that I should not have commented on the rally, since I had to resolve the authorization corresponding to the Law on Public Shows, as established by my powers," said Marcos Bergaz, who has expressed his surprise at the "hyperventilation that Medina displays, who seems to prefer to launch himself in search of the easy headline, even though it is not true, instead of studying the papers."
"It seems that his work advising the mayor of Arrecife does not leave him time to do his homework as an opposition in the Cabildo," concludes the councilor.
