An owner from Argana will have to pay almost 56 thousand euros for building a house without a license

The Agency for the Protection of the Urban and Natural Environment (APMUN) has notified a Resolution initiating sanctioning proceedings against a citizen for the alleged commission of a very serious administrative infraction in the Revised Text of the Laws on Land Planning of the Canary Islands and Natural Spaces of the Canary Islands, which occurred in the capital city neighborhood of Argana Alta.

According to an announcement published this Tuesday in the Official Gazette of the Canary Islands (BOC), the alleged infraction was carried out by the execution of construction works of a building intended for housing, located on land classified as rustic land for the protection of natural ecological value (El Jable), without the mandatory territorial qualification and building permit required in accordance with the provisions of the Revised Text of the Laws on Land Planning of the Canary Islands and Natural Spaces of the Canary Islands.

The public consortium body publishes this Resolution in the BOC as it has not been able to notify the affected party in accordance with the Law on the Legal Regime of Public Administrations and the Common Administrative Procedure.

The alleged administrative infraction is classified and sanctioned with a fine of 100 to 200 percent of the value of the affected land or the executed works, whichever is greater, depending on the circumstances in the file; the proposed fine in this case being 55,985.82 euros.

The interested party has a period of 15 days to provide allegations, documents or information and, where appropriate, propose evidence in this regard
