The Sixth Section of the Provincial Court of Las Palmas has sentenced Abdelmajid El Guermez to three years and six months in prison as the criminally responsible author of a crime of attempted sexual assault on a woman in Playa Blanca. The convicted man, 26 years old, is also prohibited from approaching the victim or communicating with her for a period of six years.
Likewise, he has been imposed a supervised release measure also for a period of six years and has been sentenced to compensate his victim with the amount of 4,000 euros.
The events, which were judged in the Provincial Court of Las Palmas on January 17, date back to January 7, 2011. According to the sentence, at around 1:20 p.m. this young resident of Uga was driving a vehicle along the Avenida del Faro de Pechiguera, in Playa Blanca. The convicted man crossed paths with a woman, who was walking and was about to cross said road.
The defendant arrived at the roundabout at the entrance to Playa Blanca and "changed direction, heading to the place where he had seen" the woman. He parked his vehicle in front of the Hotel Dunas, got out of the car and headed to the paved road adjacent to the hotel, which his victim also accessed, according to the judicial ruling.
"The accused kept walking in front of her for a few minutes touching his genitals. With the intention of attacking the woman's sexual freedom, the accused turned around heading towards her. When he was at her height, surprisingly, he grabbed her by the shoulders and pushed her. The woman fell to the ground, remaining seated", according to the sentence.
Immediately afterwards, according to this document, "the accused placed himself in front of her and, bending his knees without sitting down, rubbed his penis on the woman's face", "while applying force with one of his hands" so that the victim "would open her mouth and perform oral sex on him". "He did not achieve his purpose due to the tenacious and forceful opposition of the victim", the sentence indicates.
The sentence also states that the accused "acknowledged the facts in their entirety", despite the fact that his defense requested his free acquittal in his provisional classification. After acknowledging the facts, the Public Prosecutor's Office waived further evidence.
