The Traffic Detachment of the Civil Guard of Arrecife is investigating a 46-year-old man as the alleged perpetrator of a crime against road safety, after being located driving a motor vehicle while having a final judgment that prohibited it.
The events took place at the roundabout of the Secondary Education Institute of Yaiza, on the LZ-2 road, where agents were conducting a documentation check.
The Civil Guard is preparing the corresponding proceedings, which will be delivered to the Investigating Court on duty in Arrecife.
Penalty of three to six months in prison or a fine
As the Benemérita recalls, Chapter IV of the current Penal Code typifies crimes against road safety and establishes that anyone who drives a motor vehicle or moped in cases of loss of validity of the permit or license due to total loss of legally assigned points, will be punished with a prison sentence of three to six months, or with a fine of twelve to twenty-four months or work for the benefit of the community of 31 to 90 days.
The same penalty will be imposed on anyone who drives after having been deprived, either as a precautionary measure or definitively, of the permit or license by judicial decision, and on anyone who drives a motor vehicle or moped without ever having obtained a driving permit or license.
