Two defendants accused of selling cocaine in Arrecife, who were arrested with nearly 800 grams, to be tried

The Public Prosecutor's Office is asking for a five-year prison sentence and a fine of 199,639 euros for each of them.

The Second Section of the Provincial Court will try on September 9 two defendants accused of selling drugs at their home in Arrecife, for whom the Public Prosecutor's Office is requesting a sentence of five years in prison and a fine of 199,639 euros respectively. 

The Public Prosecutor's Office considers that "from undetermined dates", A.B. and M.S.B. "were engaged in the sale of narcotics, specifically cocaine, at their home." Specifically, the indictment states that on September 25, 2019, at approximately 8:40 p.m., the defendants sold "0.44 grams of cocaine, with a purity of 27.69%, which on the illicit market had a price of 15.9 euros."

As a result, it is noted that five days later "a judicial warrant was authorized for entry and search of the defendants' home" where different amounts of cocaine were found in bags and in the form of balls and capsules. 

 

Nearly 800 grams of cocaine seized

In total, a total of 798.53 grams of cocaine were seized, which, according to the different degrees of purity, is estimated to have a value on the illicit market of 66,530 euros. In addition, at the time of their arrest, 19,345 euros were seized. 

Both defendants, who, according to the indictment, are foreigners but reside "legally" in Spain, have been in pre-trial detention since October 1, 2019 for these events, which the Public Prosecutor's Office considers to constitute a crime against public health in the form of substances that cause serious damage to health.

 

Expulsion from the national territory for one of the defendants

In the case of A.B., it is requested that once he has served two-thirds of his sentence in a Spanish prison, the prison sentence be replaced by expulsion from the national territory and a ban on entering Spain for five years. And, in his case, although he resides legally in Spain, he has only been granted a Temporary Residence Authorization "due to exceptional circumstances" since July 2019. 

With respect to M.S.B., however, the full completion of the sentence in national territory is requested, since the Public Prosecutor's Office considers "the substitution by expulsion disproportionate given that the defendant has authorization to reside in Spain since 2007." 

The trial will be held in Las Palmas de Gran Canaria, although the parties will participate by videoconference from Arrecife.
