The woman who was attacked on Friday afternoon in Playa Honda by her partner, Stuart Paul Margerison, refused to go to court to testify and was not recognized by a forensic doctor. This is clear from the judgment issued by the judge of the Court of Instruction number 1 of Arrecife, after the quick trial held on Saturday, in which Margerison is sentenced to six months in prison as the perpetrator of a "crime of domestic and gender violence and injuries in the family environment". The woman thus waived the rights that could correspond to her by not appearing in court.
In the judicial resolution it is considered proven that around half past four in the afternoon Margerison, near a restaurant in Playa Honda, had an argument with his sentimental partner in the presence of their one and a half year old son. In the course of the discussion, "with the intention of undermining her physical integrity, the accused punched and kicked her several times". The judgment also states that the attack was witnessed by another man who intervened between the couple to stop the accused from hitting the victim.
The resolution grants the suspension of the six months in prison for a period of two years conditioned to Stuart Paul Margerison, a 40-year-old British man, not committing any crime. In addition to the six months in prison, he is sentenced to special disqualification for the right of passive suffrage during the term of the sentence and is deprived of the right to possess and carry weapons for 30 months. As accessory penalties, he is also prohibited from approaching the victim, approaching her home, place of work and any other place frequented by her, at a minimum distance of 500 meters, as well as communicating with her through any means or system for thirty months.
