The Provincial Court is studying whether Judge Ricardo Fiestras, who was denounced for participating in a party in a villa in the municipality of Yaiza when the island was at level 4 of health alert, violating the measures against Covid, can instruct a similar case.
As confirmed by the Superior Court of Justice of the Canary Islands (TSJC), the Court has admitted for processing an incident of challenge filed against the magistrate by citizens who have denounced some neighbors for organizing illegal parties during the pandemic.
The instruction of said complaint fell to Judge Ricardo Fiestras, but its authors have requested that he be removed from the case after the magistrate himself was denounced for similar events. In this regard, it should be remembered that the General Council of the Judiciary agreed to open informative proceedings on Ricardo Fiestras, to clarify if there was reason for sanction in his conduct with the agents who carried out said intervention.
The incident of challenge presented now by some citizens against the magistrate has been admitted for processing by the Provincial Court for complying with the formal requirements and because the Constitutional Court has established that the inadmissibility of an incident of challenge "must be an exceptional decision", according to the TSJC. After that, the Court must determine whether Judge Ricardo Fiestras can continue or not with the instruction of the case.
