The promoters of the Tías golf course, including the businessman Juan Francisco Rosa, have been carrying out urbanization works without a license in that partial plan and would even have invaded rustic land. This has been confirmed to La Voz from the Tías City Council, which on March 24 ordered the work to be stopped, with a decree that was executed a little over a month later.

In addition, the Seprona of the Civil Guard has opened an investigation, after receiving a complaint in mid-April. According to what this media has learned, that complaint would have been filed by a person linked to the Consistory, who warned of the execution of these illegal works. The agents then went to the City Council and are currently waiting for them to send all the requested documentation.

On the one hand, the Seprona requested a copy of the license, which the City Council confirms that the company did not have. On the other hand, it has also requested information about that Partial Plan and the type of land that is being occupied, since in the vicinity of the golf course there is rustic land and also protected land. In this way, it tries to determine if they could have incurred in a crime, beyond the "administrative infraction" that the file opened by the Consistory resolves. Afterwards, according to what they have advanced, they will send the results of their investigation to the Environmental Prosecutor's Office.

Regarding the occupation of rustic land, it would have occurred with the installation of a "practice" area attached to the golf course, according to the City Council. However, they clarify that the sealing was ordered only for lack of a license. And it is that of the other possible infraction they have transferred to the Agency for the Protection of the Urban and Natural Environment (Apmun) of the Government of the Canary Islands, which they affirm is the one that "has the powers" over that type of land.

As for the rest of the works that have been stopped, they would consist of urbanization works for "streets, sidewalks and pipelines" of that partial plan, which in reality should have been completed years ago. In fact, given the breach of the deadlines, in November of last year the City Council declared the license to urbanize that partial plan expired, which had been granted in 2001, 16 years ago.

During this time, according to municipal sources, the City Council has granted "some licenses for the residential area", for "isolated homes", but "conditioned to the complete completion of the urbanization". Finally, given the breach of the promoters, they decided to initiate the procedure to declare the urbanization license expired, which was done through a decree at the end of 2016. However, the urbanization works were "resumed", which led to the opening of a sanctioning file, within which the sealing has already been ordered and executed.

Once that file is concluded, which is still "pending reports" according to the Consistory, other possible sanctions could be established to the promoting company of these works, which is the Compensation Board of the Puerto del Carmen Golf Partial Plan. Currently, the president of the company is José Salces de León, partner of the two main businessmen who promoted this golf course, Juan Francisco Rosa and Rafael Lasso, and accused along with them in a criminal case for crimes against the Public Treasury.
