The Prosecutor's Office has decreed the dismissal of the complaint against the PP councilor in Arrecife, Nayra Callero, filed by the secretary of the Personnel Board, Narciso Pérez, who accused her of an alleged crime of malfeasance in the appointment of the acting secretary of the Corporation. Callero has expressed being "happy" upon learning of this letter from the prosecutor and has announced that she will sue Pérez for an alleged crime of slander.
In her letter, the Prosecutor's Office explains that it received the complaint against Nayra Callero on March 6, in relation to events that "could constitute administrative malfeasance." Thus, it opened investigation proceedings, which have culminated in the dismissal of the lawsuit.
In the documentation that Narciso Pérez sent to the Prosecutor's Office, possible irregularities in the appointment of Francisco Javier López as acting secretary of the Arrecife Corporation are brought to light. Pérez claimed that the appointment had occurred "without complying with the procedures imposed by article 33 of Royal Decree 1732/1994 of July 29, which regulates the provision of jobs reserved for officials of the local Administration."
In this sense, Pérez pointed out that the "infraction of article 834/2033 of June 27" had been committed, which establishes that it is necessary to request a report from the competent body of the Autonomous Community on the existence of any official with national qualification interested in the provision of this job.
The Prosecutor's Office initiated investigation proceedings, specifically, the statement of Narciso Pérez and the study of the documentation presented by him. "After its study and assessment, it can be concluded that the reported facts would not constitute, per se, any criminal act," the prosecutor states.
The prosecutor explains that the report from the General Directorate of Public Function concludes that "there is no record of any request from an official with state qualification who was interested in the provision of the job of Secretary of the Arrecife City Council." Furthermore, she assures that "compliance with the formal and material requirements in the acting appointment conferred by the Corporation in favor of Francisco Javier López has been accredited."
Exchange of statements
Radio Lanzarote was the scene in March of the exchange of accusations between Nayra Callero and Narciso Pérez. At that time, the secretary of the Personnel Board of Arrecife assured that there was "a negative report" from the Head of Human Resources regarding the appointment of the acting secretary and stated that the councilor "chose to say that she didn't care about the reports and incorporated this secretary."
Likewise, Pérez assured that he "sensed" that another report from the General Directorate of Public Function of the Government of the Canary Islands had been registered in the Arrecife City Council. In this document, according to Narciso Pérez, Public Function also warned of this appointment.
For her part, Nayra Callero took advantage of a face-to-face interview on Radio Lanzarote to announce that she would take legal action against Narciso Pérez after his accusations. "I have been insulted and slandered and I have been accused of a crime while having evidence that it does not exist," she stated. Callero showed the documents and assured that there was no negative report advising against the appointment of the secretary. Furthermore, she pointed out that this procedure was "rigorous, exact, legal, and transparent."
Callero explained that she personally went to Public Function, in Tenerife, to consult with the competent official on the procedure to follow for the appointment of the new secretary. "He gave me the instructions in this regard and they were followed to the letter," she stated at the time. Now, after the dismissal of the complaint against her, the PP councilor will make her announcement in March on Radio Lanzarote effective and sue Narciso Pérez for an alleged crime of slander.
