The Plenary of the Cabildo has complied with the order of the Court of Instruction Number 2 of Las Palmas that urged to invalidate the acknowledgment of the expulsion of Councilor Juan Manuel Sosa from the CC-PNC Political Group and his transfer to the group of non-attached members, following the precautionary suspension decreed by order of the same court.
The president of the Cabildo, María Dolores Corujo, explained that, as indicated in that order, “the aforementioned precautionary suspension will take effect until the procedure initiated by Juan Manuel Sosa against his expulsion is finalized, so the councilor fully enjoys the political rights that correspond to him.”
Corujo has also referred to a statement sent by the deputy spokesperson for Coalición Canaria, Pedro San Ginés, in which he reports that the Prosecutor's Office has proposed dismissing Sosa's lawsuit for the alleged violation of his rights. “Our position, beyond the prudence we maintained in the precautionary measures piece, is that the assumption described in the appeal has not affected the applicant's right to representation,” the Public Prosecutor's Office states in that document.
In this regard, Corujo points out that this report presented in the main procedure “does not affect the (precautionary) suspension agreed by the Court”, and adds that “it simply expresses the opinion of the prosecutor, who is one more part of the procedure, which will have to be assessed by the judge together with the allegations and arguments presented by the other parties in the process.”
In addition, she maintains that “Pedro San Ginés has deceived the Prosecutor's Office, which has ruled based on a document, the alleged Internal Regulations of the CC-PNC Group, whose authenticity is in doubt, since the falsification of the same has been reported”.
“We cannot forget that this irregular attempt to expel the councilor is related to the alleged coercion by San Ginés that the Court is investigating, the complaint having been extended to the rest of the political group for the falsification of the aforementioned regulation”, explained the president.
Regarding the hiring of an external lawyer to defend the Cabildo in the administrative litigation filed by Juan Manuel Sosa, which has also been questioned by San Ginés, the president explained that it was “the legal advice of this Corporation itself that recommended said hiring given the complexity and specialty of the case in question, proposing the hiring of said lawyer because he is a professional of proven solvency, who has an impeccable track record and magnificent results in the defense of the public interest, as indicated in the report issued for this purpose.”
“The truth is that Sosa's expulsion is suspended as a precaution and that the councilor has recovered all his rights, whatever San Ginés and Coalición Canaria say”, concluded Corujo, expressing her confidence that the courts will end up siding with Juan Manuel Sosa “against the harassment to which he has been subjected, trying to force his resignation through actions for which he will have to answer in court.”
