The Prosecutor's Office requests three years in prison for the former mayor of Tinajo, Luis Perdomo, who governed the municipality between 1980 and 1999, in his last stage with the Canarian Coalition, and four years for two other defendants, José Corujo Pérez and Andrés Cabrera García, for a crime against land management.
According to the Prosecutor's accusation, at the end of 1998, the defendant Andrés Cabrera carried out construction works and conditioning of a 40 square meter building on rustic land within the protected landscape of La Geria, in the town of La Vegueta. The construction did not have a license or prior authorization from the General Directorate of Urban Planning. Another defendant, José Corujo, was the one who carried out the works with the company Construcciones Corujo, without demanding the license from the promoter to be able to build on rustic land.
The prosecutor points out in his indictment that the then mayor, Luis Perdomo, verbally consented to and instigated the illegal construction. He assures that he verbally authorized Andrés Cabrera to build without demanding the municipal license "because he had perfect knowledge that the City Council could not grant it without obtaining another mandatory and prior license from a higher body".
Did not open file
The promoter did not present a technical project "that would have allowed knowing exactly the intentions", according to the prosecutor. He also points out that it was obvious that the work was not a mere rehabilitation of what already existed, and that the mayor did not open an urban planning infraction file or order the Local Police officers to request the license from the promoter.
The WWF Adena environmental association is involved in the procedure as a private prosecution, which highlights in its accusation that the new house is divided into several apartments that are exploited for rent to tourists. Adena requests the demolition of the construction, which consists of a two-story house with an area of about 160 square meters per floor.
