According to Espino, the company "recognizes that the Cabildo is right" and on Wednesday afternoon they reached an agreement whereby the company will lose 36 of the hotel's 862 beds, whose construction is currently stopped by court order. In addition, the company will be forced to renounce 47 residential places, which were to be built on two plots, located between the Hesperia Playa Dorada hotel and the Marina Rubicón in the town of Playa Blanca. These plots must be dedicated to commercial or leisure areas. As for the apartment complex, which is already built, the developer will not be able to increase its capacity.

Carlos Espino clarified that by virtue of the agreement signed between the Cabildo and the construction company, the latter will be obliged to recognize before a notary that it has no right to build tourist beds until January 1, 2011, when the moratorium limiting the construction of tourist places ends.

The penalty involves the loss of a total of 83 tourist beds for the company, the same number of places as the apartment complex that is already built illegally. For its part, the hotel works will be stopped for at least five more years.

In return, the Cabildo promised to close the judicial process it maintains with the company, one of the many open fronts that the first institution has with the Yaiza City Council and with development companies for granting building licenses and building tourist beds respectively, despite the moratorium in force to stop the construction of hotel and apartment complexes on the island.

Carlos Espino was satisfied with the agreement because "once again it is shown that the Cabildo is right".
