The Agency for the Protection of the Urban and Natural Environment (APMUN) has notified a citizen of a resolution ordering the demolition of illegal works located in the place called "Montaña Los Chupaderos" in Yaiza. Likewise, it has imposed a fine of more than 14,000 euros, specifically 14,623.09, for a serious infraction of the Revised Text of the Laws on Territorial Planning and Natural Spaces of the Canary Islands, as published this Monday in the Official Gazette of the Canary Islands (BOC).

This measure affects the construction of buildings located on rustic land for landscape protection, which are located within the limits of the protected landscape of La Geria. The works consist of a semi-buried construction of one story high, which occupies an approximate area of 70 square meters; a 90 square meter building for rainwater collection; a 15 square meter cistern; a cylindrical metal tank; and a track opening that occupies a length of 160 meters.

The sanction of 14,623.09 euros is imposed on the infringer for carrying out the illegal works without the necessary legitimizing titles for their execution, such as territorial qualification and building permit.

Unable to locate the neighbor

The public consortium body publishes the Resolution in the BOC, as it has not been able to notify the interested party at their home in accordance with the Law on the Legal Regime of Public Administrations and the Common Administrative Procedure, according to the Government of the Canary Islands in a statement.

In the notification, the agency orders the citizen to restore the infringed legal order, by demolishing the works. Likewise, they are required to submit to the APMUN, within a period of one month, the restoration and demolition project, as the first step in the voluntary execution of the order, warning that failure to comply with this requirement will result in the forced execution of the demolition by the Administration at the expense of the infringer, in accordance with the Law on the Legal Regime of Public Administrations and the Common Administrative Procedure.

The APMUN also informs that, if the person responsible for the alteration of the physical reality restores it to its previous state in the terms provided by the Administration, they will be entitled to a 90 percent reduction of the fine imposed in the sanctioning procedure.
