Twelve workers from the AENA information department at the Guacimeta airport have had their contracts terminated, according to Intersindical Canaria, due to the change in the company awarded for the subcontracting of this service. According to these workers and the union, this is an "unfair dismissal", since the change of company does not imply the "termination of contract" but the subrogation of the same. Therefore, in addition to filing a lawsuit, they will begin an indefinite strike starting on March 17, if AENA and the subcontracted companies do not ensure the continuity of these workers.
The contract of these workers ends on March 14, but they have already received, via telegram, the dismissal notifications. Intersindical Canaria assures, supported by article 44 of the Workers' Statute, that the labor termination is "outside the law", because when a contract is established for a work, if that service has not ended, "the new contractors have to maintain all the rights of the workers, including the contract".
In addition to the strike, they will file a lawsuit for "unfair dismissal" in the Social Court against the subcontractors Mencies Aviation Group Ibérica S.A., Sintra Aparcamientos S.A. and the company AENA for subsidiary responsibility, since, according to the workers and anticipating the change of the subcontracted companies that takes place every two or three years, they have to ensure the continuity of the contracted personnel.
