Coverage approved for rent defaults announced by Sánchez

The Council of Ministers has approved the Royal Decree establishing the regulation of coverage for potential rent defaults for housing rental contracts that President Pedro Sánchez announced last week.

The objective of this coverage, which will be managed by the autonomous communities of common regime and the cities of Ceuta and Melilla, is to facilitate access to housing for certain groups, such as young people and vulnerable individuals.

To have this coverage, landlords must meet four essential requirements, which the autonomous communities may expand upon with additional criteria if they so wish.

The first is to sign a contract with people under 35 years of age or vulnerable individuals as established in each region, and the second is that the rental income does not exceed the state reference index.

In third place, **deposit the mandatory legal bond** for the rental contract, as well as its updates, and in fourth place, **sign the commitment with the tenant** regarding the rent guarantee, according to the model approved by the Administration

The new guarantee will compensate for unpaid rent, damage caused to the property, and outstanding utility costs. 

The beneficiaries of this measure, who must be up-to-date with their tax and Social Security obligations, will be the landlords of the properties and the autonomous communities if they have signed an insurance policy with the landlords.

Coverage will be limited to eventual defaults and damages generated in contracts in effect as of January 30, 2025.

A budget line will be enabled in the coming dates to finance this measure. The Autonomous Communities must send information to the Ministry of Housing and Urban Agenda semiannually regarding the coverages applied.
