Trial against real estate administrator suspended due to lawyer's Covid positive

The events occurred two decades ago and their trial has been postponed again. The Prosecutor's Office requests 5 years and 9 months in prison for the accused for a crime of misappropriation.

One of the trials that was going to be held this Tuesday in Arrecife by the Sixth Section of the Provincial Court of Las Palmas, against the sole administrator of a real estate company, had to be suspended after the lawyer tested positive for Covid.

The hearing will thus be pending a new date being set, when two decades have already passed since the events occurred.

In its qualification brief, the Prosecutor's Office requests 5 years and 9 months in prison for the accused for a crime of misappropriation, for having kept 91,000 euros that a client delivered as a signal, for two homes that he never received. In addition, the Public Prosecutor's Office also demands that he pay a fine of 7,200 euros and that he return the money to the victim, with the corresponding interest.

The two contracts with purchase option were signed in 2002, when this real estate company was building several homes in Arrecife. The entity that was going to acquire them delivered those 91,000 euros as an advance of the total sum, which amounted to 499,000 euros.

The contract established that the maximum delivery period for the two properties expired in 2005, but after that date the entity “did not obtain the homes that corresponded to it, nor the return of such amount, receiving constant evasions and excuses from the accused”, according to the Prosecutor's Office.

“With an evident desire to enrich himself at the expense of other people's assets, he did not apply the payments to the intended purpose, appropriating the aforementioned sum,” adds the indictment. The trial had been set for this Tuesday and an agreement of conformity could have been reached, but finally the hearing could not be ratified or held, for which a new date will now have to be set.
