Nearly 6 years in prison requested for the administrator of a real estate company who appropriated 91,000 euros from a client

The events occurred two decades ago, when the accused sold two houses under construction that he never delivered, and will be judged next week

The Sixth Section of the Provincial Court of Las Palmas will judge next Tuesday a man accused of appropriating 91,000 euros from a client, through the real estate agency of which he was the sole administrator. The Prosecutor's Office is asking for 5 years and 9 months in prison, a fine of 7,200 euros and the return of the money to the victim.

The events occurred two decades ago, in 2002, when this real estate company was building several homes in Arrecife. In September of that year, the accused signed two purchase option contracts with an entity, on two homes valued at 129,000 and 370,000 euros, both with a parking space. For this, the victim gave an advance of 91,000 euros, establishing a maximum delivery period for the properties that expired in 2005.

However, once that period had expired, the indictment states that the entity “did not obtain the homes that corresponded to it, nor the return of such amount, receiving constant evasions and excuses from the accused.”

“With an evident desire to enrich himself at the expense of other people's assets, he did not apply the payments to the intended purpose, appropriating the aforementioned sum,” the Prosecutor's Office adds.

Thus, he asks that he be convicted of a crime of misappropriation and that he compensate the victim both with the amount he delivered and that he could never recover, as well as “in those others that he proves as economic damage derived from the events.”
