Three and a half years in prison requested for keeping part of the sale of a hotel in Lanzarote

The Public Prosecutor's Office accuses L.A.C.L. of having "taken for himself" and incorporated into his assets 128,400 euros and of not having returned it to the company that sold it as was his obligation.

The Provincial Court of Las Palmas will try this week in Lanzarote a defendant for a crime of improper association for allegedly taking part of the money he obtained after selling a property shared with other partners.

The Public Prosecutor states in his qualification document that the defendant L.A.C.L., as joint administrator of the company Villas de La Geria SL, allegedly with the aim of obtaining "an illicit patrimonial benefit" sold the Diamar hotel, located between Fred Olsen and Manolo MIllares streets in Arrecife, for 2.6 million euros and kept part of the profits from the transaction.

The sale took place in June 2013 before a notary in Murcia to the company Alessa Europa, legally represented by J.A.A.R. The defendant ratified the sale by means of a public deed before a notary in Arrecife.

According to the Public Prosecutor's Office, the payment of the sale was made by means of a bank check in the name of the company Atalaya Canaria SL, owned by the defendant. The Public Prosecutor's Office accuses L.A.C.L. of having "taken for himself" and incorporated into his assets an amount of 128,400 euros, which was not returned to the company as was his obligation and harming the company Villas La Geria SL and the rest of the partners.

The Prosecutor's Office qualifies the facts as a crime of misappropriation in all cases and asks for the defendant a sentence of three years and six months in prison, special disqualification for the right of passive suffrage during the time of the sentence and a fine of ten euros per day for nine months, with subsidiary responsibility in case of non-payment.

In addition, it demands that the defendant compensate R.M.A.C.L. as representative of Villas La Geria SL with 128,400 euros.
