The Sixth Section of the Provincial Court of Las Palmas will judge this Tuesday in Lanzarote the owner of a cafeteria in Costa Teguise for allegedly defrauding more than 158,000 euros from Social Security by not paying the fees of its workers for almost four years.

In the indictment to which La Voz has accessed, it states that O.M.M.F. was the administrator of Valto Café SLU, a company that managed Bar Surwings, located on the beach of Las Cucharas in Costa Teguise. Specifically, the Public Prosecutor's Office states that the accused "did not pay the fees that were withheld from the workers" from October 2016 to January 2020. Specifically, between interest, costs and surcharges, the amount defrauded amounts to 158,981.04 euros.

The Prosecutor's Office points out that the accused "with the evident purpose of frustrating the collection", but to continue with the hotel business, constituted a commercial company, with the same address and corporate purpose as the previous one. The creation of this commercial company did not mean that it assumed the debts of the previous one, but without registering it with the General Treasury of Social Security and "without having workers or material resources".

The Public Prosecutor's Office classifies these facts as constituting an aggravated crime against Social Security and a crime of concealment of assets.

Therefore, he is asking for four years in prison, a fine of 600,000 euros, with the subsidiary personal responsibility of ten months in prison in case of non-payment, the loss of the possibility of obtaining subsidies or public aid and the right to enjoy tax benefits or incentives or Social Security for six years, as well as disqualification from the right to passive suffrage during the term of the sentence and the payment of costs for the crime against Social Security.

In addition to another four years and six months in prison, a fine of 21 months at 200 euros a day and with subsidiary personal responsibility in case of non-payment, as well as disqualification from the right to passive suffrage during the term of the sentence.
