The Provincial Prosecutor's Office of Las Palmas linked the new magistrate of the Constitutional Court, Enrique Arnaldo, to a "mendacious report" to "provide legal cover" for the approval of the Costa Roja urbanization, in Lanzarote, which also sought to "shield" the actions of the mayor who approved the license, which was later declared illegal. The former mayor of Yaiza, José Francisco Reyes Rodríguez - who already has several convictions for corruption, and in the Yate case confessed to receiving bribes in exchange for granting illegal licenses - is still awaiting trial for that case.
In a Prosecutor's Office document dated March 14, 2013, an email is included that was discovered after a search carried out by agents of the Central Operative Unit (UCO) of the Civil Guard. In this document, the businessman Luis Lleó Khünell gives "thanks for the professional time dedicated" by Enrique Arnaldo and Rafael Entrena, brother of his partner Ramón, during their stay in Madrid and, "getting to the bottom of the matters discussed", gives them instructions to prepare a report favorable to the construction of the urbanization, which also ended up being paid for by the City Council.
But the police search was declared null months later by the Sixth Section of the Provincial Court of Las Palmas, which upheld the appeal filed by the promoter Luis Lleó Khünell, so the evidence obtained, including the message addressed to Arnaldo, could not be used as evidence in the judicial investigation.
In the email that had to be left out of the case, it is read how the businessman conveyed some instructions to Arnaldo and his partner's brother about the content that the opinion should include, which was intended to serve as an alibi to defend the legality of the Costa Roja urbanization, and for which the Yaiza City Council paid 27,000 euros to an Entrena company.
"They ask me to do it in the following way: an engagement letter signed by the drafter of the opinion and the mayor dated March 6, 2007 to carry it out with a deadline until May 15, 2007. They ask me to send it signed and the City Council stamps it for us, and the mayor signs it where we put the object of the opinion, deadline and price. The date of the engagement coincides six days after the Cabildo requires the City Council to give a copy of the administrative file of the building permit", specifies the message addressed to the lawyer of Congress and Entrena.
