The First Section of the Provincial Court will judge next week six defendants for the two violent robberies that took place in August 2018 in Costa Teguise: the assault on a house in which a couple was attacked and the robbery at the gates of the Aquapark, both committed at gunpoint.
Specifically, the hearing will be held from March 16 to 18 and the Prosecutor's Office is asking for a total sentence of 19 and a half years in prison for two of the defendants, A.J.S.M. and D.G.S.D., who are considered the perpetrators of both robberies, in addition to being charged with three counts of injury. For them, a fine of 1,350 euros is also requested.
For another of the defendants, the Public Prosecutor's Office is asking for five years and six months in prison as an "accomplice" in one of the robberies and for the remaining two defendants two years in prison for a crime of concealment.
Assault on a house
The assault on a house in which a couple was attacked took place in the early hours of August 10, 2018, while its occupants "were inside sleeping". During the same, according to the Prosecutor's Office, the assailants fired a firearm twice that they were carrying against the man, although the shots did not reach him. However, they gave him "kicks and blows all over the body, even trying to turn his head".
To the woman, one of the accused "pointed the gun at her head" while "telling her to hand over the money and gold" and "kicked her and threw her towards the bed." In addition, according to the indictment, "he tied her hands behind her back" and "began to search the closets, taking 4,600 euros from a shoe box, and then taking her to the hall", where he put "the gun to her head, forcing her to kneel on the floor".
There, according to the Public Prosecutor's Office, "he tied her hands with a cable and her feet with some cords, leaving her tied on the floor, the defendants abandoning the houses at that time, stealing various electronic effects, telephones, watches, jewelry and cash."
As a result of the aggression, the man suffered multiple injuries, especially to the head and different parts of the face, for which "he did not require hospital admission", but needed "specialized medical assistance" for 130 days. In addition, he was left with "sequelae with slight aesthetic damage."
As for the woman, she had injuries to one eyebrow and suffered an acute stress disorder, needing 30 days to recover.
To "facilitate" the commission of this robbery, the Prosecutor's Office maintains that another of the accused, J.F.P., who was a "friend" of the victims' son, "provided information" to the alleged assailants of when "the occupants of the house were alone to access the home." Therefore, he is accused of being an "accomplice."
Regarding the stolen effects, the indictment indicates that they were recovered, "except for the amount of 4,600 euros", another "1,000 euros" owned by the victims' son, "two watches and a ring owned" by the woman.
Robbery at the gates of the Aquapark
As for the robbery of an Aquapark worker, it took place ten days after the other robbery, specifically on August 20, 2018.
According to the Public Prosecutor's Office, at around 08:30 on that day and "hiding his face with a balaclava", A.J.S.M. and D.G.S.D approached the Aquapark employee and "threatening him with a firearm, they shouted 'Give me the money or I'll shoot you'", hitting him with the weapon. After that, they appropriated "the toiletry bag where he was carrying the weekend's collection", which "amounted to 16,055 euros."
Subsequently, the Prosecutor's Office maintains that these two defendants moved a vehicle that had been "stolen", as well as the effects that had been stolen from the house and the money stolen from the Aquapark worker to the house where they both resided, in Arrecife. The same is pointed out that it was rented by E.L.G, also living in it D.M.G and G.D.R.B, who are the three accused of a crime of concealment.
And it is that, it is considered that they helped the main defendants "hiding the stolen effects in the aforementioned address, as well as hiding the amount of 14,840 euros on the roof of said building, which were recovered by the agents."
Compensation for the victims
In addition to the prison sentences and fine, the Public Prosecutor's Office also requests that the two main defendants compensate the victims.
For the couple from the assaulted house, a total of 14,200 euros are claimed in compensation for the injuries caused and for the money stolen. In addition, it is requested that the woman be compensated in the amount determined in execution of the judgment for a gold wedding ring and a watch engraved with her father's name.
Likewise, the Prosecutor's Office requests that A.J.S.M. and D.G.S.D compensate "jointly and severally" with 130 euros to the Aquapark employee who was robbed for the injuries suffered.
