The First Section of the Provincial Court of Las Palmas de Gran Canaria has dismissed the appeal filed by a defendant of sexual abuse against the Criminal Court number 1 of Arrecife, who was convicted of touching a woman's buttock in the street, thus confirming the penalty that was assigned to him.
The events occurred last December 2020, when, as denounced by the affected party and stated in the judgment of the Court of Arrecife, "a man who was walking along a street in the capital approached the complainant with the intention of satisfying his most reprehensible sexual instincts and, without saying a word, touched one of her buttocks and looked at her lewdly."
The victim, being aware of what happened, requested the help of her mother, who was walking a few meters ahead on this road.
Court sentence
On May 12 of this year, the Criminal Court of Arrecife issued a sentence condemning the perpetrator for a crime of sexual abuse.
Based on this, it determined that the perpetrator of the events should face "a penalty of 18 months and 15 days of fine with a daily fee of 6 euros, in addition to compensating the affected party with an amount of 250 euros for the moral damage derived from the events."
However, the man filed an appeal against this ruling.
Ruling of the Provincial Court
Now, the First Section of the Provincial Court of Las Palmas de Gran Canaria has dismissed said appeal, reiterating and confirming the sentence issued by the court of Lanzarote.
In this way, the court has indicated that "the imposed fine must be maintained" and also "the indicated compensation, for the evident damage caused and which is the result of the emotional alteration suffered by the victim."
