The defendant accused of sexual abuse, exhibitionism and corruption of minors against a 5-year-old boy and two teenagers aged 12 and 15 in Arrecife acknowledged this Monday the facts before the First Section of the Provincial Court of Las Palmas, accepting a sentence of 8 years and 11 months in prison, according to the newspaper La Provincia.
The man, 37 years old and a native of Colombia, confessed from the moment of his arrest, "collaborated" with justice and showed "his repentance”, as highlighted by the Prosecutor's Office, which reduced the requested sentence by applying these mitigating factors.
During the hearing, all parties confirmed that they will not appeal the ruling, so the Court issued the sentence in voce and declared its firmness. The convicted man, who has no prior criminal record, has been in pre-trial detention for these events since February 24, 2020, so the time he has already spent in prison will now be deducted.
The public prosecutor stated in his final conclusions that, from April 2018 to December 2019, he maintained conversations “of a sexual nature” through WhatsApp with a minor of 12 years. In addition, he had sexual encounters with this victim “until the minor turned 13 years old”, which consisted of “mutual touching and masturbation”.
In addition, during the last six months of 2019, the convicted man had “up to four sexual encounters” with a five-year-old boy, whom he had access to thanks to the friendly relationship with the minor's family. He abused him until he turned 6 years old, with “all kinds of kisses”, in addition to masturbating him.
The third victim was captured through Instagram at the end of 2019, when the minor was 15 years old. The defendant sent him photographs of his genitals, and managed to get the victim to send him a nude photograph “from the waist up”, although in this case he did not manage to get him to agree to meet him in person despite his “repeated propositions”.
Y.J.M was arrested on February 24, 2020, when the National Police searched his home and seized a computer with more than a thousand photographic and video files in which minors appear in “explicit sexual attitudes of all kinds”.
The Court also imposed the payment of compensation to the victims, the total of which amounts to 47,000 euros, in addition to the special disqualification to exercise any office that involves regular contact with minors for 20 years, as well as the prohibition of activities that involve contact with minors for ten years.
In addition, the public prosecutor requested that, once access to the third degree is granted or provisional release is granted, the remainder of the sentence be replaced "by expulsion from the national territory", with the consequent prohibition of returning to Spain.
